True, but I believe that the police can only hold the person until they either show they are a danger to others (which gets the judge involved again) or it is shown that no danger to others exists. It's a temporary suspension, yes, but still within the framework of the legal system.

True. It does take legal intervention...most states, anyway.
But, the reason I raised the question wasn't as much to get answers (are there any?) as it was to show how difficult the "mental health" angle is compared to straight out "banning guns". Meaningful mental health legislation would be a booger-bear to sort through. OTOH, gun-control has been up for public debate for so long that it's the easy way out.
We are, for the first time, hearing a lot about the mental health issue. While the media that I've listened to and read doesn't mention it as often as gun-control, it's taking a much larger place on the stage than ever before.
Any you know what......it's gonna come down to it's easier to legislate firearms. All the talk about mental health care reform is going to die a quiet death once a few executive orders dealing with firearms comes out.
Until the next time. Then the next. Then the next.
At some point a whole lot of folks are going to have to get as worked up about mental health legislation as they currently are about gun control.

Among the Executive Orders signed by President Obama today, 1,2,3,4,16, and 17 will provide the NICS system with more reasons to deny approval to a gun buyer. There is now a real danger of the government imposing serious political and legal consequences on a citizen just for seeking medical attention. Given these new risks, any mentally ill citizen who contemplates seeing a shrink should have his head examined.

He can recommend that Congress pass certain legislation, but he can't force it. Now it's our turn to call/write our Congress-weasels and let them know that voting in favor of these recommendations will result in their removal from office next election.
