Yeah I'm really surprised this hasn't propped up more here. Then again most conservatives seem to be perfectly fine on dropping hellfire's from the sky on suspected terrorist regardless of where they are and if they're American citizens or now. Due process is far too inconvenient to apply to the GWOT. You've usually got to go into the liberal blogosphere to find people outraged at the targeted killing of American citizens.

Due process only applies within the criminal justice system. The war on terror is not a police action, it is war, and terrorists are not considered criminals but enemy combatants. The war on terrorism is asymetrical, and the enemy has been found to hold many different nationalities, including our own. Enemy combatants can be home grown, and they are entitled to no more consideration than any other combatant under arms against the United States. Think of them as Confederate soldiers during the Civil War. Since the U.S. didn't recognize the C.S.A., all Confederate soldiers were considered Americans, but since they were under arms and in rebellion, they were killed without any 'due process" necessary. BTW, their cities were also bombarded, their fields burned, livestock slaughtered, infrastructure destroyed, harbors blockaded, etc. Thankfully, we haven't had to go that far yet.

I'd like to ask Holder if it's legal then why did they make what happened at Kent State a criminal act. Just like everything else it's legal as long as it goes along with their agenda.
