Does anyone recall this case in court?

Does anybody recall the case of the individual that had a semiautomatic firearm go full auto on him while at the range and was convicted of having a machine gun? I think the case started in Wisconsin.

    US vs Olofson?  If that's the one you're referencing, it may not have malfunctioned on him. I mean, if it has a third position the selector switch can move to, and you tell someone it can do that, and you're trying to sell it, you're getting into a nebulous area.

    Yes, the NFA and the machine gun ban is unconstitutional.  But until they're overturned, we're going to have to live with what we have.

    Was he convicted?  Ive heard about this case but have never seen anything official on it.  I also find it hard to believe that if he was in fact convicted they must have found out it was a willful modification to the firearm.

    Check the links I provided.  He was convicted and sentenced to 30 months in prison. He knew of the "problem," told the guy he was trying to sell it to of the "problem," and told him how to induce the "problem."

    The conviction was not because he modified the firearm - seems they couldn't prove that.  But he was convicted of knowingly trying to transfer a machine gun.

    OK, thanks Bream, guy on another forum is having a problem with a 9MM style AR shooting bursts and he was talking about it on the internet and I was wondering if he was 1/2 way to a bad day. Mixed manufacturers parts seems to be the problem.

    Not really, actually I've found quite a few conversations about that on the net.  It is a possibility that as you mentioned, usually happens when you mix/match parts without understanding the inner works of the gun, and the solution is simple, a lighter recoil spring/lighter buffer to get it to cycle properly.  

    They are not machine guns, they have no prohibited full auto parts in them, only legitimate semi-auto parts, they are just malfunctioning guns that need tuning.  Now if he willfully built it that way, leaves it as is and then tries to sell it like the guy above that is a whole different story.

    "The prosecution also provided evidence from Olofson's computer with proof of acquiring M-16 parts, which could be used to make an AR-15 automatic. Olofson also "had contact with vigilante groups" and indicated he was "part of the sovereign movement", according to U.S. Assistant Attorney Gregory Haanstad."

    He knew exactly what he had and was trying to sell it as such...

    I've had an occurrence that involved me contacting the atf for an illegally modified gun. It was a Century Arms C308 that the guy bought used at a gunstore. He took it to the range where it was firing FA. He figured it was a malfunction and brought it to me. I did a quick field strip and removed the trigger pack only to realize that I had to call the alphabet people because you could see where someone hacksawed and filed a FA trigger pack to fit in the SA gun. You wouldn't believe how difficult it was to get ahold of someone to deal with it. I finally had two agents show up that I was able to show them why I had called. They seemed thoroughly surprised and said that it's a rarity and that I did the right thing. They signed it out of my book and took it. That was last September and the guy got it back, minus trigger pack around June or so. They sent it to Quantico for testing and determined that it was a factory part and the disconnector had worn. Apparently Century Arms used to include crappy craftsmanship in making their guns which included an actual FA trigger pack frame modified for SA use. And I can assure you that it looked like a guy in his shed took a hacksaw and file to it. I did my due diligence.

    From what I've read, Century Arms has done some sketchy stuff with their CETMES and C308s.  Parts looking like they were ground with a bench grinder, your hacksaw incident.

    Dang, I got moderated on that other Forum for daring to suggest that it might be unwise to post on the internet about having something be full auto, even it was not intentional, got lectured to by a couple posters, apparently the BATFE is warm and cuddly in their neck of the woods.

    Read a review of Century Arms AKMs awhile back.  The reviewer made the observation that it looked like a drunk monkey with a Dremel tool had been working on it.  Led to a meme - Century Arms - Because Drunk Monkeys Need Jobs Too.
