Robbers pick the wrong Denny's, armed customer fights back

Here in Houston, a couple of armed men went into a Denny's to rob the customers, but one of the customers was also armed and returned fire, chasing off the robbers.

None of the customers was injured, including the guy with the gun. The robbers may also have avoided being wounded but no further word thus far.

Heres's the brief story from the Houston "Cramicle", er, Chronicle

I wouldn't be surprised if Denny's now posts 'NO GUNS" signs on all their stores and sued the armed citizen who fought back.

Ohhh! Just read the article. He fired at the van as it was going away. Even in Texas , that's gotta be a no-no!

I guess that part that is covered in all the CCW classes tends to go in one ear and whistles out the other ear.
Common sense seems to be in short supply too.

I always love to hear about folks standing up on their hind legs and fighting back....then I read that they did something stupid like shooting at a fleeing vehicle, not a good idea...

Agree. Shooting at a fleeing vehicle? The ol' adrenalin got the better of him, I think. What with the robbers being obviously on a bad-boy mission and the customer, at least at the beginning, doing the proper self defense thing, I'm guessing he'll not have any charges filed, probably just a talking-to by the shooting team to remind him that the final actions were questionable. Thus far, no harm, no foul.

Re. Texas law, I'm not totally sure whether his shooting at the fleeing van was technically legal or not. I tend to think no, but Tx has some strange self defense laws that are only active "after sunset", including allowing use of lethal force protecting property only. But while the guys are getting away and did NOT steal something? I doubt it.

The guy did step over the line and I'm sure he'll be reminded of that, but I'm guessing no charges.

Not only that , if he was shooting at a fleeing vehicle , he most likey wasn't paying attention to whatever else was in that direction , or beyond it. Reckless endangerment sounds like a start , if there were any homes , businesses beyond.

No, they weren't. The only gunfire was inside Denny's. The defender stepped way over the line when he went outside to pursue the robbers.

He wasn't charged although even in Texas, he'd broken the law, but I'm betting the cops sat him down and gave him a thorough talking-too and warning.
