Robbers pick the wrong Denny's, armed customer fights back

Here in Houston, a couple of armed men went into a Denny's to rob the customers, but one of the customers was also armed and returned fire, chasing off the robbers.
None of the customers was injured, including the guy with the gun. The robbers may also have avoided being wounded but no further word thus far.

Ohhh! Just read the article. He fired at the van as it was going away. Even in Texas , that's gotta be a no-no!
Common sense seems to be in short supply too.
Re. Texas law, I'm not totally sure whether his shooting at the fleeing van was technically legal or not. I tend to think no, but Tx has some strange self defense laws that are only active "after sunset", including allowing use of lethal force protecting property only. But while the guys are getting away and did NOT steal something? I doubt it.
The guy did step over the line and I'm sure he'll be reminded of that, but I'm guessing no charges.
No, they weren't. The only gunfire was inside Denny's. The defender stepped way over the line when he went outside to pursue the robbers.
He wasn't charged although even in Texas, he'd broken the law, but I'm betting the cops sat him down and gave him a thorough talking-too and warning.
